Membership Policy

  1. Portions of this Site (www.kickstart.com.my) provide you and other users an opportunity to submit, post, display, transmit and/or exchange information, ideas, opinions, messages, transmissions or material ("Post" or "Postings") with us, the Site or other users/visitors to the Site. 
  2. Messages or materials posted to NESCAFÉ® KICK-START™ Forum by members/users are solely the opinion and responsibility of the person posting the message. Nestlé shall not be held responsible or liable in any way for the authenticity, accuracy, originality or quality of any of the Postings.
     
  3. Postings do not reflect the views of Nestlé, and Nestlé does not have any control over the Postings. Nestlé is not obliged to monitor, edit or screen any Postings. However, Nestlé has the right , if it so wishes, to remove or edit any Postings, which violates any of the policies herein or in its sole discretion and opinion finds objectionable. 
     
  4. Notwithstanding anything else in this NESCAFÉ® KICK-START™ Forum policy, Nestlé should not be seen as endorsing or responsible for any Postings in any way. Nestle disclaims any responsibilities or liabilities, arising whether directly or indirectly, for any damage or loss caused by any of the Postings.
     
  5. Neither Nestlé nor its subsidiary companies, its respective officers, directors, and employees, subsidiaries and/or affiliates shall be liable for any Posting that is in violation of this Policy or any law, rules or regulations currently in force or hereafter be enacted.
     
  6. Nestlé assumes no responsibility for any failure to store or post any Postings submitted, posted or transmitted due to any reasons whatsoever or any changes that may take place during transmission or submission of the Postings.
     
  7. By submission of the Postings on this site, you agree to abide by the policies contained herein and any policies, guidelines, rules or regulations now existing or subsisting within this Site or as varied, ammended or added from time to time without any further notice or reference to you.
     
  8. Nestlé will fully cooperate with any law enforcement authorities or court order requesting or directing Nestlé to disclose the identity of the author of the Postings or is of the opinion that such disclosure is necessary to enforce any policies, guidelines or rules or regulations herein contained in this Site or hereinafter contained. You agree to comply with any additional terms which are referred to on this Site or any policies, guidelines or rules or regulations found within the website.
     
  9. Nestlé reserves the right to modify or temporarily or permanently discontinue the NESCAFÉ® KICK-START™ Forum without any notice or liability whatsoever.
     
  10. You shall be fully responsible for the origin, legality, validity, correctness or truthfulness of the Postings. Nestlé will not be held liable in any way whatsoever for any of the contents of the Postings. You agree to indemnify and keep Nestlé and/or its subsidiaries, affiliates, employees, staff or agents indemnified and harmless from any claims, demands or suits made by any third party due to your Postings.
     
  11. You are to follow acceptable standards of behaviour when posting messages online. Nestlé reserved the right to terminate any member privileges of using NESCAFÉ® KICK-START™ Forum services as we deem fit in our sole discretion.
     
  12. >The following types of postings are cause for immediate post removal, suspension or termination of member registration. You agree not to submit, transmit or post any materials that –
    12.1 Will interfere with anyone else's use of the Site or services
    12.2 Are abusive, harmful, threatening, unlawful, vulgar, political, racially or ethnically abusive, hateful, profanity, defamatory, libellous, tortious, indecent, obscene, offensive, misleading or threatening in any way;
    12.3 Encourage any visitors to the NESCAFÉ® KICK-START™ Forum to view or download from any external link.
    12.4 invite or solicit any business, transactions or responses through unauthorised advertising or promotions. Postings are for non-commercial purposes only and you may not Post in any manner which does or is intended to advertise services or merchandise
    12.5 Violate or infringe any copyright, trademark, patent or any other intellectual property or proprietary rights of others;
    12.6 Interfere with the privacy of any other user;
    12.7 >Contains any software virus or any other harmful computer codes;
    12.8 Contains any false or misleading statements of fact or descriptions whatsoever;
    12.9 Uses programming language, active or other coding, which may interrupt site operations; or
    12.10 violates or incites or encourage others to break the law or conduct, whether intentionally or otherwise and whether such violation or incitement or encouragement constitute a criminal offence or otherwise.
     
  13. You accept that Nestlé 
    13.1 may at its sole discretion limit your Postings on the Site and may impose validity period to your Postings on the NESCAFÉ® KICK-START™ Forum or to delete, erase or remove any of your Postings from the NESCAFÉ® KICK-START™ Forum as and when it so wishes without further notice or reference to you;
    13.2 may, with or without prior notice, terminate or suspend your membership and deny you access to the NESCAFÉ® KICK-START™ Forum upon the happening of, but not limited to, breaches or violations of any of the Policies herein contained or hereafter enacted or breaches or violations of any other guidelines, rules or regulations within this Site; 
    13.3 there may be times and circumstances whereby the Site will not be available to you due to unexpected technical or security or any other unforeseen problems and Nestlé shall not be held liable upon such occurrences;
    13.4 expressly disclaims any warranties of any kind whether express or implied; 
    13.5 makes no warranty that the NESCAFÉ® KICK-START™ Forum will be available continuously and is secure or error-free;
    13.6

    shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages including but not limited to loss of goodwill, use, data or other intangible losses resulting from the use or inability to access the Site or any other matter relating to the Site or to the NESCAFÉ® KICK-START™ Forum.
     

  14. You will be solely liable and responsible for any damage caused to your computer system or its related paraphernalia or loss of data as a result of accessing the Site.
     
  15. No failure or delay by Nestlé in exercising or enforcing any of the power, right or provision under this policy or any other guidelines, rules or regulations shall operate as a waiver of such power, right or provision nor shall the knowledge or acquiescence of Nestlé hereto of or in a breach of any of the policy, guidelines, rules or regulations constitute a waiver of such policy, guidelines, rules or regulations. 
     
  16. Any policy or any other guidelines, rules or regulations which is illegal, void, prohibited or unenforceable, in whole or in part, shall to that extent be severed from and be deemed not to form part of this policy but the validity and enforceability of the remainder of this Agreement shall not be affected or invalidated.
